Student Agreement Contract

1. The Agreement 1.1 This is an Agreement Contract for the Provision of Training (“Agreement”) by and between you (the “trainee”), and Pure Line Academy by Leana Bernot Ltd (the “training provider”) of 121 Grantham Road, Sleaford, Lincolnshire, United Kingdom NG34 7NP. 1.2 This Agreement is effective upon the trainees’ signature or payment for or usage of the training services or materials, each of which constitutes an agreement to these terms. 1.3 This agreement applies to training courses, program or certification testing offered by the training provider and provided to the trainee. Training services may include, but are not limited to; (a) Classroom training at the training provider’s location, (b) Onsite training at the trainee’s designated location, (c) Instructor-led remote training, (d) On demand pre-recorded audio/ video sessions available over the internet; and (e) Certification exams.   1.4 In order to provide training appropriately, the training provider may also provide slides documents, examples, test questions and other materials. By signing this agreement the trainee agrees to comply with the training providers copyright notice. 2. Trainees Obligations 2.1 Some of the Training services may require the trainee to have specialised knowledge or have completed prerequisite courses. The training provider will
endeavour to notify the trainee of any such requirements (on its site or otherwise), but the trainee is responsible for assessing the suitability of the Training Services or of its Attendees for enrolment. Further, the training provider makes no guarantee that enrolment in appropriate prerequisite classes will result in Attendees passing a related Exam (if involved).
The training provider will not provide any refund based on a failure to meet prerequisites. 2.2 To properly utilize the Training Services, the trainee may need to meet particular software or hardware requirements (for example, appropriate computers or appliances, stable Internet connection, verification of network communication paths, up-to- date web
browser, operating system, etc.). The training provider may post such requirements online or otherwise inform the trainee of such requirements. The Trainee is responsible for meeting such requirements. If technical issues arise during the Training Services, the training provider will use commercially reasonable efforts to resolve such problems but will
have no liability based on the trainee’s failure to meet technical requirements. 2.3 Trainees must meet the training providers standards for appropriate behaviour during the Training Services. The training provider reserves the right to dismiss (without refund) a trainee from any instance of the Training Services to maintain a productive classroom environment. In particular, the training provider will not permit trainees to harass other students or instructors, or to act inappropriately or disruptively. Further, trainees may not disclose Exam questions or answers to other trainees or any other third party and may not provide assistance to other trainees taking the Exams. In such cases, the training provider will have no obligation to provide a refund or a certification. For all Training Services taking place at the training provider designated site, trainees agree that they will leave all facilities in the same condition as initially provided. 2.4 The trainee further agrees to attend the training session as planned and will notify the training provider of any reasons why this will not be possible. Where possible we ask the trainee to provide at least 48 hours’ notice if they are unable to attend. 2.5 The trainee accepts that at the time of signing they have no known psychological or physiological problems that may inhibit their ability to carry out their training course, this includes but is not limited to; alcohol or drug dependency and blood
borne viruses. 2.6 The trainee also accepts to follow the rules set out in their Covid-19 declaration and will follow the suitable instruction of the trainer to maintain the health and 
safety of all attendees. 2.7 In the unlikely event of a needle stick injury, the trainee agrees to have their blood tested for any potential viruses and diseases. 2.8 The trainee also accepts not to hold the training provider liable for damages, costs or expenses that arise from treatments carried out by the trainee following their training course. Furthermore the trainee will not hold the training provider liable for the trainee’s failure to conduct their business successfully after their training course. 2.9 The trainee accepts not to offer this training course, or any training course offered by the training provider for a minimum period of 2 years following the completion of their course. 2.10 The trainee must inform the training provider by calling 07547 401020 in any event that means the training course is no longer suitable. 2.11 The trainee accepts that arriving any more than 30 minutes late to their training course means that they will be unable to take part in the training and all fees remain payable in full. 3. Training Providers Obligations 3.1 The training provider will ensure any training is only carried out by a qualified instructor and will only use 3rd party instructors where necessary. 3.2 The training provider will ensure their site is accessible to the trainee and any materials they may be required are available to the trainee. 3.3 The training provider also accepts to provide you a certificate upon the completion of the course. This certificate will have two parts, one of which will be provided to the trainee and the other is to be held by the training provider. 3.4 The training provider reserves the right to change the location of any training, in any event the trainee will be notified as soon as possible with a new location. 4. Photo Consent 4.1 I consent to Pure Line Academy by Leana Bernot Ltd (the “Training Provider”) using photographs and/or video recordings of me taken by the Training Provider or by persons or organisations authorised on behalf of the Training Provider for the purposes of internally and externally promoting the Training Provider. These images could be used in any media (existing or later created or made available) including print and digital media formats such as print publications, prospectuses, brochures, websites, e-marketing, posters, banners, advertising, film, social media, teaching and research purposes. 4.2 I understand that images on websites can be viewed throughout the world and not just in the United Kingdom and that some overseas countries may not provide the same level of protection to the rights of individuals as EU/UK legislation
provides.   4.3 I understand that some images or recordings may be kept permanently once they are published and be kept as an archive of the Training Provider. 4.4 I agree that: - I will not be paid a fee in respect of any use made of the photograph(s) and/or video recording(s) but have the opportunity of being involved in promoting the Training Provider in the manner set out above; - Copyright in the image(s) and/or video recordings will be retained by the Training Provider; and - The Training Provider shall have the right to edit, modify, crop, add to or subtract from the photographs and/or video recordings at its entire discretion and without my approval. 4.5 The Training Provider is committed to processing
information in accordance with the General Data Protection Regulation (GDPR).  The personal data collected on this form will be held securely and will only be used for administrative purposes. 5. Payment and Pricing 5.1 Prices will be those in effect on the date the trainee orders the Training Services. Prices do not include any expenses required by trainee to access the Training Services (for example, Internet access fees). The training provider reserves the right to increase prices at any time without prior notice. The training provider will not be responsible for any refunds for Training Services except as explicitly described in this Agreement. 5.2 The trainee may request a different date for their training, this may only be requested on one occasion and can only be accepted with notice of a minimum of 5 business days. Any changes to your training dates are at the discretion of the 
training provider. 5.3 All training fees must be paid in full 14 days before the
commencement of any training. These fees are non-refundable unless expressly permitted by the training provider. 5.4 Upon booking a training course, a non-refundable deposit is required as detailed below; - Full course cost if the course is less than £700. - £300 if the course is between £700-£1500 - £500 if the course is between £1501-£2000 - £750 if the
course is between £2001-£3500 - £950 if the course is greater than £3500. 5.5 The full cost of the course is required if its commencement of the course is within 2 weeks. 5.6. Shadowing will be offered free of charge to trainees who attend an in-person course within 6 months of the completion of their course. A charge of £250 is payable if outside this 6-
month period. 5.7 In the event of an act of God (pandemic, war, natural disaster) then all fees remain non-refundable, and a new date will be offered to the trainee. 6. Your Rights Under GDPR 6.1 You have the right to request to see a copy of the information we hold about you and to request corrections or deletions of the information that is no longer required.  You can ask the Training Provider to stop using your images at any time, in which case it will not be used in future publications but may continue to appear in publications already in circulation.     7. Governing Law and Jurisdiction These terms are governed by the law of England and Wales and are subject to the exclusive jurisdiction of the courts of
 England and Wales.
